Congratulations to Kelsey Shewbert who prevailed in Robert T. Baum v. Home Depot, U.S.A., Inc. (Alaska Sup. Ct. No. 1836-July 21, 2021). This matter involved a customer who tripped on pallets in the middle of the store aisle and fell, tearing his rotator cuff.

HWS Law Group recently prevailed on a motion to strike Plaintiff’s request for a trial de novo in Pierce County Superior Court. Defendant argued that Plaintiff’s request for a trial de novo should be stricken due to Plaintiff’s failure to perfect their request under RCW 7.06.050 because it was not signed by the Plaintiff himself as required under the statute.

In this matter, Plaintiff claimed traumatic carpal tunnel syndrome as a result of a significant rear end motor vehicle accident where Plaintiff was pushed into the vehicle in front of him and airbags deployed while he was firmly gripping the steering wheel preparing for impact.
